Guardia — Terms of Service
DRAFT — prepared for Guardia LLC. Not final until reviewed and approved by the company's attorney. Do not publish as final terms before that review.
Operated by: Guardia LLC, a Washington limited liability company ("Guardia," "we," "us"). Effective date: [to be set at public launch] Contact: [support email / domain to be inserted once hosting is live]
By creating an account or using Guardia, you agree to these Terms. If you do not agree, do not use the service.
1. What Guardia is
Guardia is a co-parenting tool: shared messaging with optional AI assistance, a shared calendar and expense log, guided court-paperwork preparation, deadline calculations based on court rules, and a tamper-evident shared record with certified exports.
Guardia is just a tool. You are solely responsible for your case — for checking that this is accurate and true, for what you send and file, and for your deadlines. Guardia provides legal information and document help. It is not a lawyer, and it does not give legal advice.
Guardia LLC is not a law firm. No attorney–client relationship is created by using Guardia. Nothing in the app — including anything said by Faro, our AI guide — is legal advice, a legal strategy, or a prediction about any case or outcome. Court rules and deadlines shown in the app are legal information drawn from published sources; courts can change rules, and the court's own records control if there is ever a difference. Always confirm critical dates and requirements with the court or a licensed attorney.
2. Eligibility and accounts
- You must be at least 18 years old and legally able to enter this agreement.
- You are responsible for your account, your password, and everything done under your account. Keep your login credentials private.
- Information you enter must be accurate to the best of your knowledge. Entering false court information, impersonating another person, or creating an account for someone else is prohibited.
- A Guardia "case" is shared by two parents (and any viewers or professionals a parent grants access). By joining a case, you agree that the other members of that case can see the shared record as described in §3.
3. The shared record
- Messages, once sent, are locked: they cannot be edited or deleted by either parent. This is deliberate — the record's integrity is the point of the service.
- If Buffer Mode is on, the record keeps both versions of a relayed message — as written and as delivered — visible to both parents.
- Every AI action on a message or document (tone check, buffer rewrite, summary, flag) is logged and auditable by both parents, including what changed and why.
- Certified exports reproduce the shared record with a verifiable integrity chain. An export reflects what is in the record; Guardia does not certify that the contents are true — only that they are untampered. A passing integrity check does not guarantee that any court will accept, admit, or rely on an export.
- Journal and record entries are written by the parents; Guardia does not verify them. Keeping an entry in the record does not guarantee that a court will admit it, believe it, or rely on it.
- Private journal entries are private to their author except entries the author chooses to share. Location information attached to journal entries is never shared with the other parent.
4. AI features (Faro and Buffer Mode)
- Faro provides general legal information and document-preparation help only, using published rules for your jurisdiction where a verified rule pack exists. Where coverage is not verified, the app says so.
- Buffer Mode rewrites tone, never facts: names, dates, times, amounts, and other facts are preserved exactly, and the original is always kept (§3). Threats, child-safety concerns, and emergencies are never softened — they are relayed as written and flagged.
- Documents are built only from your answers, your facts, and the evidence you provide — Guardia does not invent facts. When Guardia reviews evidence or flags what supports a document, that is assistance, not verification: Guardia does not certify that any evidence is true, complete, or admissible, and no document is guaranteed to be accepted by a court or to produce any result.
- Check-ins and support flags compare the shared record against the confirmed plan terms and show facts only — they are not findings, verdicts, or legal conclusions. Seeing no flag is not a guarantee of compliance, correctness, or safety: it means only that the check found nothing in the record it reviews.
- AI output can be wrong. Review everything before you send or file it. You — not the AI and not Guardia — are responsible for what you send and file.
5. Paperwork, deadlines, and filing
- Documents Guardia helps you prepare are working drafts built from your own answers and facts. Transfer them to your court's official forms where required, review them fully, and sign them yourself.
- Guardia's deadline calculations are information, not a guarantee. Filing deadlines are set by the court under its rules; if a computed date and the court's date differ, the court's date governs.
- Nothing in Guardia is "filed" with any court unless a confirmed filing status says so. Guardia never represents that a document has been submitted to or accepted by a court without confirmation from that court.
6. Acceptable use
You agree not to use Guardia to:
- threaten, harass, stalk, or intimidate any person;
- send content that is unlawful, or that endangers a child;
- falsify records, backdate entries, or attempt to alter the locked record or its integrity chain;
- access another user's account or any case you do not belong to;
- interfere with the service's operation, security, or other users' access.
Guardia provides in-app tools to report content to the operator. Guardia does not offer blocking: the shared record is a court-usable log both parents are entitled to, so neither parent can hide or erase the other's words. We may suspend or terminate accounts that violate these Terms, and we may preserve and disclose records where required by law or court order.
7. Safety
- Guardia is not an emergency service. In an emergency, call 911 (or your local emergency number).
- The app includes a Quick Exit feature and domestic-violence resources. Using them is always free and never requires a subscription.
8. Trial, subscription, and payment
- Free trial: new accounts receive a 30-day free trial with full features. No payment card is required to start the trial.
- Price: after the trial, Guardia costs $1 per month per parent, charged to each parent's own payment method. Hardship waiver codes are available through legal-aid and self-help partners at no charge.
- Billing channel: subscriptions are billed on the web through Stripe (at guardiacoparenting.com); the apps do not sell the subscription. When a trial ends without a subscription, the account becomes read-only: the shared record stays fully visible and exportable, and sending and paperwork pause until the parent subscribes or a waiver covers them.
- Filing Center: filing through the Filing Center is pay-per-filing, separate from the subscription: you pay the court's filing fee (a pass-through — Guardia does not set it) plus a Guardia filing fee of 6% of the court fee, with the total shown before you pay. If a filing does not go through — the court rejects it, the submission fails, you withdraw it before submitting, or it is still unsubmitted 7 days after payment — the entire charge is refunded automatically, court fee and Guardia fee alike. Payment is never filing: a filing counts only when the court issues an envelope number.
- You may cancel at any time; cancellation stops future charges and takes effect at the end of the current billing period. Subscription fees already paid are non-refundable except where required by law; filing payments refund as described above.
- Prices may change with at least 30 days' notice in the app before the change applies to you.
9. Privacy
Our Privacy Policy (published in the app and at [privacy policy URL]) explains what we collect, why, and your choices, and is part of these Terms. In brief: we do not sell personal information; the shared record is visible to the members of your case; private journal locations are never shared.
10. Account deletion
You may delete your account in the app at any time (More → Delete my account). Deletion removes your personal data and login. Because the shared record belongs to the case, entries you contributed to a shared case remain in that case's record in attributed, tombstoned form ("Deleted parent") so the record's integrity chain stays complete; cases with no other members are deleted entirely. This is described in plain language in the deletion flow before you confirm.
11. Intellectual property
Guardia, including its software, rule packs, text, and design, belongs to Guardia LLC or its licensors. You keep ownership of the content you enter; you grant us the limited license needed to store, process, relay, and display it to your case members and to operate the service.
12. Disclaimers and limitation of liability
- The service is provided "as is," including during beta, when features may change, break, or be unavailable. We do not warrant that the service will be uninterrupted, error-free, or that any computed deadline or generated document is correct.
- To the maximum extent allowed by law, Guardia LLC's total liability to you for any claim arising from the service is limited to the greater of (a) the amounts you paid us in the 12 months before the claim or (b) $50.
- Nothing in these Terms limits liability that cannot be limited under applicable law.
13. Indemnification
You agree to indemnify and hold harmless Guardia LLC from claims, damages, and reasonable costs arising from your use of the service, your content, or your violation of these Terms — including claims arising from documents you prepared with Guardia's help and chose to file.
14. Governing law and disputes
These Terms are governed by the laws of the State of Washington. Any dispute arising from these Terms or the service will be brought in the state or federal courts located in Washington, and you consent to their jurisdiction. If any provision of these Terms is found unenforceable, the rest remain in effect.
15. Changes to these Terms
We may update these Terms. Material changes will be announced in the app at least 14 days before they take effect. Continuing to use Guardia after a change takes effect means you accept the updated Terms.
16. Contact
Questions about these Terms, or reports of abuse: [support email]. Bug reports may also be sent from inside the app (More → Report a problem).
